These TOU represent a binding contract between you and HelloChinese, and by creating an account or otherwise accessing HelloChinese, you expressly agree to be bound by them. The TOU incorporate the provisions of the Privacy Policy, so please review them carefully as well. If you do not agree to be bound by the TOU, you may not use or purchase HelloChinese.
Membership of HelloChinese is void where it does not accord with our registration obligations, described here. You agree to maintain and promptly update the Registration Data to keep it true, accurate, up-to-date and complete. You furthermore agree to all of the terms and conditions of these Terms of Use. If HelloChinese has reasonable grounds to suspect that any information you provide is untrue, inaccurate, not current or incomplete, we retain the right to suspend or terminate your account and refuse any and all current or future use of the Service.
You are responsible for maintaining the confidentiality of your Account details and you are fully responsible for all activities that occur under your Account. Your Account must be used only by you and must not be shared with, or transferred to any other individual. You must immediately notify us via our Contact Us page of any suspected or actual, unauthorized or fraudulent use of your Account or any other breach of security.
You agree that we may send communications to your email address for customer service, confirmations, newsletters, product offers and other matters.
You may choose to opt out of much of this email by using the links at the bottom of our emails.
We take our users' privacy extremely seriously. Your Registration Data and certain other information about you is subject to our Privacy Policy, which can be seen at https://www.hellochinese.cc/privacy.html. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information.
HelloChinese is protected by international intellectual property laws and you agree to abide by them. Without our prior written consent, you may not download, copy or store HelloChinese content in any form outside of HelloChinese and you may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works based on, distribute, or perform any HelloChinese content. You agree to comply with reasonable written requests from us to help us in protecting our proprietary and intellectual property rights in HelloChinese. All intellectual property rights in HelloChinese are, as between you and HelloChinese, the sole and exclusive property of HelloChinese.
Some HelloChinese features either now or in the future may allow you to post or submit content and materials for publication on HelloChinese (“Your Content”). You own any intellectual property rights to Your Content, but you agree that we can use, reproduce, modify, adapt and publish Your Content for purposes of enabling us to offer HelloChinese or the features you have elected to use. You are responsible for Your Content, and acknowledge that once published, we cannot always remove it.
We appreciate when you provide us feedback through customer service or by email or social features, but we may use any feedback, comments, or suggestions without any obligations to you.
HelloChinese is used by millions of people. We expect, in turn, that our users do not misuse our products and services In addition, by assenting to these Terms of Service, you represent, warrant and agree that you will not:
use the Service or App to harm minors
use the Service or App to intimidate, stalk, mock, lambast, scare, pervert or otherwise harass another individual;
use the Service or the App in any unlawful manner including, but not limited to, the intentional or unintentional contravention of any applicable local, national or international law.
use the Service or the App in any manner that could overburden, damage, disable, or impair the Site;
use the Service or the App to harvest or collect email addresses or other personal information from our users whether by electronic or other means for any purposes whatsoever, including but not limited to those of sending unsolicited emails or messages of any other kind;
register for more than a small number of User accounts on the service;
register for a User account on behalf of an individual other than yourself;
register for a User account for which you falsely state personal information or otherwise misrepresent yourself; or with which you impersonate other people maliciously.
By using the site, you further understand that HelloChinese may be obliged, under legal pressure from governmental institutions in the countries in which we operate, to access, preserve and disclose information relating to your Account.
HelloChinese may offer different subscription plans and gift plans; and the specific pricing terms applicable to your account may vary depending on promotions, the type of subscription and the term you select at the time of purchase (e.g., monthly or annual).
If you choose a monthly plan, your Premium Account subscription will run from month to month, and will renew automatically at the end of each monthly period. Payment for the next monthly period will be taken at that time, unless you cancel your Premium Account.
Annual accounts run for twelve months from the date on which your Premium Account is activated, and your subscription will renew automatically at the end of that twelve month period, unless you choose to cancel your Premium Account.
By providing payment information to us, you agree that the payment information is valid and (1) in your name or (2) in the name of an individual who has authorized you to use their payment information for your subscription purchase. If you provide someone else's payment information, you agree that we may refund payment to that person if they so request and if the account is eligible for a refund under this Payment Policy. This may cause interruption to or termination of your HelloChinese service.
HelloChinese subscriptions of yearly plan made through our website or customer service team offer a 30 day money back guarantee. You may receive a refund by contacting our customer service team within 30 days of your purchase. After that 30 day window, we will not provide a refund. We do not prorate refunds or offer partial refunds, and we do not offer refunds for monthly subscriptions.
Please NOTE that if you purchase a subscription through the Apple iTunes Store or our android, iPhone or iPad applications, the sale is final, and we will not provide a refund. Your purchase will be subject to Apple's applicable payment policy, which also may not provide for refunds.
We may occasionally need to change the features of our Premium Accounts and/or change the prices charged for these accounts. In the event of any increase in the price or material reduction in the features of any Premium Account to which you subscribe, we will communicate these change(s) to you at least four weeks in advance and the changes will only take effect with respect to any subsequent renewal of your subscription.
We reserve the right to modify, temporarily suspend or permanently delete your Account and terminate your access to the Services if we have reason to believe that you have breached or acted inconsistently with the Terms.
We comply with the provisions of the Digital Millennium Copyright Act applicable to service providers. If you have any complaints with respect to material in our App, you may contact us by email to support@hellochinese.cc
You must include the following information in your complaint:
a description of the copyrighted work or other intellectual property that you claim has been infringed;
a description of the material that you claim is infringing and where it is located on HelloChinese;
your mailing address, telephone number, and if available, email address;
a statement by you that you have a good faith belief that the use of the material on HelloChinese is not authorized by the copyright owner, its agent, or the law;
a statement by you that the above information in your notice is accurate and that, under penalty of perjury, you are the copyright or intellectual property owner or authorized to act on behalf of the copyright or intellectual property owner; and
an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other right being infringed.
You expressly agree, understand and warrant that HelloChinese, including its officers, friends, employees, affiliates, agents, partners and licensors, shall not be liable to you for any damages at all.
Included among the damages for which you expressly agree that we are not liable are damages due to loss of profits, academic misadventure, loss of health, or data, or other intangible assets (even where HelloChinese has been advised of such damages in advance).
The company's liability, notwithstanding anything to the contrary contained in these Terms of Use, and regardless of the form of the action, will irrevocably be limited to the total amount paid, if any, to HelloChinese in the course of an individual's membership. Note that in no case will The Company's total liability exceed $1000. In the case where no fees have been paid by you to HelloChinese, then you shall be limited to injunctive relief only, and shall not be entitled to any damages of any kind.
You expressly understand, warrant and agree that:
HelloChinese and its officers, employees, agents, partners and licensors make no warranty first that the service will meet your requirements or expectations; secondly that the service will be continuous, accurate or secure; and thirdly, that the results following from use of the service will be desirable.
Your Use of the Service, which is provided on an “AS-IS” and “as available” basis, is your sole responsibility, and is at your sole risk. HelloChinese and its officers, employees, agents, partners and licensors expressly disclaim all warranty of any kind.
Any material downloaded through the App or the Service is so downloaded at your own sole risk. In addition, the medical consequences of using HelloChinese are your sole responsibility.
Should any part of this document be shown to be legally incoherent or inapplicable, you understand that the relevant inadmissible section will be excised from this agreement without any diminution to the legal force or relevance of any and all other sections, which will continue to stand.
